Terms of Service

These Terms govern your access to and use of the SizeFit AI platform ("Service") operated by SizeFit AI Technologies. By creating an account or installing the widget you agree to these Terms.
1. The Service
SizeFit AI provides a rule-based size recommendation engine, an embeddable shopper widget, an analytics dashboard, and supporting APIs. We do not warrant that any recommendation will be correct for a given shopper; recommendations are advisory.
2. Account and eligibility
You must be a legal entity or person able to enter into a contract. You are responsible for keeping login credentials confidential and for activity under your account.
3. Acceptable use
- No reverse engineering, scraping the dashboard, or attempting to bypass quotas or RLS.
- No uploading product data you do not have the right to use.
- No using the API to build a competing sizing engine.
- No collecting shopper measurements without showing our consent UI (or an equivalent).
4. Plans, fees, billing
Pricing is at /pricing. Subscriptions renew automatically until cancelled. Fees are charged in EUR via Stripe. Quota overages on Starter/Growth/Pro plans cause widget recommendations to return a soft error until the next billing period or an upgrade.
Refunds: monthly plans are non-refundable; annual plans pro-rated on cancellation within the first 30 days.
5. Data ownership
You own your product data, size charts, and the aggregate analytics derived from your store. We process shopper data on your behalf as described in the DPA.
6. Service levels
We target 99.5% monthly uptime on Starter/Growth and a contractual 99.9% on Pro and Enterprise. Scheduled maintenance is announced 48h in advance.
7. Warranty disclaimer
The Service is provided "as is". To the maximum extent permitted by law we disclaim all implied warranties including merchantability and fitness for a particular purpose. We do not guarantee any specific conversion lift or return-rate reduction.
8. Limitation of liability
Our aggregate liability arising out of or in connection with these Terms is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.
9. Termination
You may cancel at any time from the billing page. We may suspend or terminate accounts that violate these Terms, with notice except where law or security requires otherwise.
10. Governing law
These Terms are governed by the laws of the Netherlands. Courts of Amsterdam have exclusive jurisdiction, without prejudice to consumer protection rights in your country of residence.
11. Changes
Material changes are announced via dashboard 30 days before they take effect. Continued use after the effective date constitutes acceptance.
